PUTRAJAYA, April 28 — PKR’s Chua Tian Chang can file a petition to the High Court to appeal his disqualification from contesting in the elections if he is unhappy with it, the Election Commission (EC) said today.

Its chairman Tan Sri Mohd Hashim Abdullah, during a press conference here, said such grouses can be expressed through the petition complaint, which will be the prerogative of the courts.

“Any nominees who feels they need to object can do so through a petition and present it to the court,” he said, when asked about Chua, also known as Tian Chua.

“We have to see rules and laws was enforced upon him, how much is the fine and what the court decided.”

Hashim, when asked if a petition process could be completed in time to resubmit nominations said the length of the legal process was beyond his control.

“Do not say he cannot contend. The length [of proceedings] will be decided by the court, when the trial will take place and when the decision will be made.

“We will adhere to any decision made by the court,” he said. 

Chua was disqualified from being nominated for the Batu parliamentary seat after an EC official decided he was ineligible because he had been fined RM2,000 by the High Court in March, after being convicted of insulting the modesty of a police officer.

Mohd Hashim said the returning officer who disqualified Chua must have had basis for his decision.

“Even if I wanted to comment on the incident, it happened elsewhere and we are now here.

“Like I have said, if he is unhappy he can bring the petition up to the court,” he added.
