PUTRAJAYA, May 4 — The Court of Appeal today upheld the conviction and fine on six individuals including former Rembau PKR chief Badrul Hisham Shaharin for participating in an illegal assembly and rioting in 2013.
A three-man panel comprising Datuk Kamardin Hashim, Datuk Yaacob Md Sam and Datuk Abdul Karim Abdul Jalil upheld the convictions and RM6,000 fine on Badrul Hisham, 39, better known as Chegubard and Edy Noor Reduan, 37, after striking out their appeals as they did not turn up in court today for the hearing.
Both men were found guilty of the charges and fined a total of RM6,000 each by the Sessions Court. Their appeals were dismissed by the High Court in March last year.
The same panel dismissed similar appeals by three other individuals, Norazimah Mohamad Nor, 42, Ahmad Shauqie Abdul Aziz, 27 and Lim Sue Pei, 30.
A retired teacher, Annie Ooi Siew Lan, 72, also lost her appeal to set aside her conviction and fine of RM2,000 for participating in the same assembly.
Justice Kamardin who chaired the panel said the High Court judge had not erred, that the convictions of the four individuals were safe.
They were fined RM2,000 in default three months’ jail by the Sessions Court on May 31, 2016 for participating in the assembly with intention to cause public nuisance at Jalan Parlimen, Kuala Lumpur between 9.15 am and 11.25 am on June 24, 2013.
Except for Annie, the other five individuals were also fined RM4,000 in default six months jail for rioting at the road junction leading to the Parliament building at 11.25 am on the same day.
They lost their appeals in the High Court on March 28, last year. They paid the fine.
Lawyer Haijan Omar represented the appellants while deputy public prosecutor Ahmad Sazilee Abdul Khairi appeared for the prosecution. — Bernama
