SHAH ALAM, Nov 29 — A lorry driver who was charged with the murder of his 14-day-old baby boy, more than a year ago, was acquitted and discharged by the Shah Alam High Court today, as the court found he was highly intoxicated at the time of the incident.
Judge Datuk Akhtar Tahir ruled at the end of the prosecution case that the prosecution could not prove that R. Ramesh, 42, had committed the act and had the intention, for the court to convict him for the murder of R. Kiran, while in a state of intoxication.
Ramesh was charged with killing Kiran at a house in Jalan Kemudi 2M, Taman Bernam Jaya Hulu Bernam, Hulu Selangor at 12.05am on April 12, last year.
Describing the incident as “very unfortunate”, Akhtar said that even if Ramesh was not sentenced, he would regret over what had happened for the rest of his life.
Furthermore, he said, the only witness who saw the kicking and stomping of the baby was Ramesh’s daughter, and she was unsure whether he had accidently stomped on Kiran or otherwise.
However, he noted, that the doctor who examined the deceased, found that Kiran’s death was not due to a fall from a swing but as a result of kicking and stomping.
“It is very difficult for the court to determine what actually had happened on the day of the incident,” said Akhtar.
The statements of the prosecution witnesses comprising the accused’s daughter, wife and brother-in-law mostly contradicted one another,” added Akhtar.
Ramesh was represented by Sreekanth Pillai while Iswa Tonie appeared for the prosecution. — Bernama
