KUALA LUMPUR, Nov 24 ― Representatives of former MIC Youth leader Datuk T. Mohan have confirmed he will file a new lawsuit against former anti-crime activist  S. Gobikrishnan after his earlier bid was struck out in the High Court yesterday.

The court decision yesterday was only due to “technicalities” and does not prevent him from filing a new suit against Gobikrishnan who had two years ago accused him of having underworld links, they said in an emailed statement to Malay Mail Online last night.

“Due to some technical problems in the e-filing system there was misunderstanding of filing of certain documents in Court and this resulted in the suit being struck out on technicalities. However it was struck out with liberty to file afresh.

“Since the striking out was only on technicalities, Datuk T. Mohan is given leave to file afresh. A new suit will be filed in due course to pursue the claim against Gobikrishnan,” the statement said.

Mohan’s lawyers also highlighted that Gobikrishnan’s counter-claim against the MIC man was rejected for non-compliance with directions given during case management previously.

In a series of posts on Twitter two years ago,  Gobikrishnan, a former adviser with crime watchdog MyWatch, had accused Mohan of being the patron of the Gang 36, led by one “Kajang Devan” who was named in a government list of triad members released in September 2013, in its war against crime.

Mohan denied the claim and said he would sue Gobikrishnan.

Gobikrishan’s lawyer M. Manoharan told the Malay Mail Online yesterday that High Court Judge Datuk Yeoh Wee Siam dismissed Mohan’s suit because the latter failed to follow the court’s instructions on filing some documents at the case management stage.

Mohan’s lawyer R. Thanasegar was also contacted yesterday for comment, but had declined then, saying he needed permission from his client.
