PUTRAJAYA, March 30 — The Parole Board under the Home Ministry (KDN) has approved former Selangor menteri besar Dr Mohamad Khir Toyo’s application to be released on parole after six months in Kajang Prison.
KDN secretary-general Datuk Seri Alwi Ibrahim said Dr Mohamad Khir would serve another two months outside of prison under supervision and would be completely free on May 29 if he does not breach any of the parole board’s conditions.
Under Malaysia’s prison system, said Alwi, a prisoner is entitled to a remission of one third of his sentence if the Prisons Department finds his rehabilitation while in prison to be satisfactory.
“In regard to Dr Mohamad Khir, he was given a remission of four months, and needs to serve only eight months of his 12 months’ sentence which began on Sept 29, 2015,” he said.
Alwi in a statement today to clarify any confusion in Dr Mohamad Khir’s release, said the latter is bound by the Parole Order (Subsection 46H(3) Prisons Act 1995 (Act 537), which has 27 conditions.
“Among the conditions were that he has to report to the Klang parole officer at a time and address stated in the Parole Order.
“He must also participate in a rehabilitation programme as directed and is not allowed to leave the district without the permission of the parole officer and prohibited from leaving Malaysia,” said Alwi.
He said Malaysia’s parole system was implemented in 2008 and the parole board issued its first parole order on July 26 the same year involving 64 prisoners.
“Since the system’s implementation till March 14, 2016, a total of 12,550 prisoners had been released on parole,” he said.
Alwi said prisoners with a minimum one-year’s sentence could apply for parole.
Prisoners with convictions under the Fourth Schedule of the Prison Act (Act 537), such as waging war or attempting to wage war against the Yang di-Pertuan Agong or Yang Dipertua Negeri are not eligible for parole.
Other prisoners who are not eligible for parole include those guilty of making or giving false statements with intention to cause a person to be convicted for an offence that carries the death sentence; rape; and carnal intercourse against the order of nature,” he added. — Bernama
