KUALA LUMPUR, Aug 3 — The lawyer for three activists arrested over last week’s #TangkapNajib rally is seeking for the High Court to review their remand periods of between four and six days.
Lawyer Michelle Yesudas said the detention orders for Adam Adli, Ahmad Syukri Razab and Mandeep Singh were “excessive”.
“We think that the magistrate’s remand order for our clients...are without basis, unlawful and excessive...we hope that the court would set a hearing under Section 325 of the Criminal Procedure Code (CPC),” she said.
“The remand for Mandeep was based on a wrong fact...they are all arrested for a rally that has not occurred at the time.”
Michelle added that they hope for a hearing date to be set by afternoon today.
Adam, Ahmad Syukri and Mandeep were arrested last Friday for their involvement in the Saturday rally demanding Prime Minister Datuk Seri Najib Razak’s arrest.
Police arrested 29 participants in the rally, including three opposition lawmakers.
The Demi Malaysia youth group that organised the #TangkapNajib rally has insisted that the event was lawful despite the authorities previously claiming otherwise.
Those arrested will be investigated under Section 143 and Section 124 of the Penal Code, which cover unlawful assemblies and activities that threaten parliamentary democracy, respectively.
