KUALA LUMPUR, Sept 21 — Two Perak assemblymen and four others were ordered by the Magistrate’s Court here today to enter their defence to a charge of obstructing a Kuala Lumpur City Hall officer from carrying out his duties during the ‘#KitaLawan’ illegal rally last year.

Magistrate Nur A’minahtul Mardiah Md Nor made the decision after finding that the prosecution had proven a prima facie case against the accused.

“Throughout the hearing, all the evidence given was not distorted, and therefore the court views that the charge should not be amended, as it is not misleading,” she said.

The six are Parti Keadilan Rakyat assemblymen Chang Lih Kang, 35, (Teja) and Tan Kar Hing, 33, (Simpang Pulai); Gombak District Villages Liaison Officer Chee Chu San, 40, his assistant, Yong Ming Chong, 48; former Subang Jaya municipal councillor N. Tamilarason, 53; and activist Gan Zhi Mou, 24.

All the accused were charged with obstructing DBKL officer Mohd Hariyadi Mohd Nor, 34, and his team from carrying out their duties near a fountain at the Jalan Tun Perak/Jalan Raja Laut intersection in Dang Wangi here at 12.25am on March 27, 2015.

They were charged under Section 186 of the Penal Code which carries a maximum jail term of two years, and a maximum fine of RM10,000, or both, upon conviction.

The court also ordered Chee to defend himself on another charge of using criminal force against another DBKL officer, Fuat Mat Yusoff, 50, to prevent the latter from performing his duties as a public servant on the same date, time and place.

Chee was charged under Section 353 of the Penal Code for the offence which provides for jail up to two years, or a fine, or both, upon conviction.

The court set two days — Nov 28 and 29 — for all the accused to defend themselves. They were represented counsel Gobind Singh Deo, Haijan Omar, Melissa Sasidaran and Eric Paulsen.

The prosecution was handled by deputy public prosecutor Mohamad Fadhly Mohd Zamry. Fourteen prosecution witnesses were called to testify. — Bernama
