TAIPING, Nov 11 — A vehicle repossessor and makeup artist were discharged and acquitted by the High Court here today of trafficking in 53,337 gm of cannabis last year.
Mohd Kamal Johari, 42, and Fairul Rizal Abdul Wahab, 35, from Kuala Lumpur had jointly been charged with committing the offence at Kilometer 47.8 Jalan Kuala Kangsar-Gerik near here at 8.35 am on Jan 30, 2012.
Justice Datuk Ahmad Nasfy Yasin held that the prosecution failed to establish a prima facie case against the duo.
According to him, the prosecution failed to prove custody, control and knowledge of the substance by the two accused.
“The chemist report cannot be accepted as the chemist was not called to testify,” he added.
Deputy public prosecutor Muna Mohamed Jaafar reperesented the prosecution. — Bernama
