PETALING JAYA, Nov 14 — The Magistrate’s Court today sentenced an unemployed man to five months jail and fined him RM3,000 for having discharged pepper spray onto the face of a Subang Jaya Municipal Council (MPSJ) enforcement officer.

Magistrate Nurulhuda Zakariya imposed the sentence on Leng Wan Kwan, 50, after he pleaded guilty to using criminal force to prevent Norsafuan Nordin, 31, from clamping his car at a parking lot at Jalan Puteri 1/4, Bandar Puteri, here at 12.40 pm on Nov 7.

The charge, under Section 353 of the Penal Code, provides for a maximum jail term of two years or a fine, or both.

The court ordered the father of two to serve the jail sentence from today and another three months if he failed to pay the fine.

In mitigation, Leng, who was unrepresented, appealed for a light sentence on the grounds that he was jobless and had just undergone an eye surgery.

However, deputy public prosecutor Natasya Chin Le Jy asked the court to impose a jail sentence in view of the increasing number of such cases.

According to the facts of the case, Leng’s car was clamped and towed away by the enforcement officer as it was illegally parked.

Leng, who was enraged by the action, discharged the pepper spray onto Norsafuan’s face, which left him having breathing difficulties. — Bernama
