KUALA LUMPUR, Dec 1 — A married couple today filed a suit for negligence against the police and the government over the death of their son, a policeman who was shot by a colleague at the Security Control Branch of Istana Sultan Kedah three years ago.
The couple, Md Sidek Salam, 63, and his wife, Mayah Ibrahim, 62, filed the suit last August 26 through the legal firm of Hazizah & Co.
The media obtained the suit when the matter came up for case management before Judge Datuk Noraini Abd Rahman today.
The case was set for another case management on February 17 next year.
Md Sidek and Mayah named eight defendants in the suit.
They are Lance Corporal Rosli Abu Hasan and his wife, Azlin Rahman, 30, as the first and second defendant respectively, and Inspector Mohd Yusnaidi Mohd Junoh was named the third defendant.
The Kota Setar district police chief, Kedah police chief, Perak police chief, Inspector-general of Police and the government were named the fourth to eight defendant, respectively.
In the statement of claim, the couple stated that their son, Muhammad Sobri, was on duty with Rosli at the Main Gate of Istana Anak Bukit, Alor Star, Kedah, from 3pm to 11pm on April 26, 2012, and that it was the first time the two policemen were paired.
The couple claimed that on the day of the incident, Rosli shot the victim, who was at the Senior Guard Post, at close range with a Rifle M-16 and Walter P99 pistol at about 5.45pm.
They claimed that a post mortem report on the victim found that the victim sustained external and internal injuries due to multiple shots at close range, by at least nine bullets from two different firearms.
Following the incident, Rosli was charged in the Alor Setar High Court with murdering Muhammad Sobri.
The couple claimed that during the defence stage, Azlin (Rosli’s wife) testified in that her husband preferred to be alone in the room, did not sleep for four days and nights, liked to dream, talked to himself about four to five months before the shooting incident.
They said a specialist doctor, Datuk Dr Suaran Singh, who examined Rosli found the policeman of unsound mind on the day of the incident and was suffering from serious mental problem or schizophrenia.
It was based on the testimony by the doctor that the Alor Setar High Court acquitted and discharged Rosli of the murder charge, but ordered him to be detained at Hospital Bahagia Tanjung Rambutan, Hulu Kinta, Perak.
The couple claimed that the third to the seventh defendant were negligent in carrying out their duties pertaining to their supervision of Rosli before stationing him as an armed security guard at the main entrance to Istana Anak Bukit Alor Star, Kedah.
They claimed that the third, fourth and fifth defendant were negligent in appointing Rosli for the task of handling firearm as he was not able to understand and comply with the standard operating procedure (SOP) on the use of the firearms.
They are seeking special damages of RM24,200, including for funeral expenses for the victim, as well as general, aggravated and exemplary damages, cost and other relief deemed fit by the court. — Bernama
