PUTRAJAYA, March 7 — Stesen Televisyen Malaysia Berhad (TV3) filed an application yesterday for a review of the Court of Appeal's decision on February 25, which found the TV station liable of defaming former Perak mentri besar Datuk Seri Mohammad Nizar Jamaluddin.
Media Prima Berhad's TV Networks group managing editor Datuk Mohd Ashraf Abdullah filed the notice of motion and supporting affidavit through Messrs T. H. Liew & Partners.
Mohammad Nizar sued TV3 and its Buletin Utama producer Rohani Ngah over his tweets about the vehicle registration number WWW1 bid that was clinched by the Sultan of Johor for RM520,000 in May 2012.
The High Court had ruled in favour of TV3 and dismissed Mohammad Nizar's RM50 million defamation suit against the TV station.
However, a Court of Appeal panel, led by Justice Datuk Mohamad Ariff Md Yusof, allowed Nizar's appeal and ordered the case to be remitted to the High Court for assessment of damages after it found TV3 liable for defamation.
TV3 is seeking to set aside the Court of Appeal decision favouring Nizar on grounds of coram failure.
The applicant contended that one of the Court of Appeal judge should have disqualified himself from hearing the case because of his prior involvement and connection with PAS.
