SEPTEMBER 15 — In “Kampung Sungai Baru landowners compensated fairly at market value with ancillary claims” I wrote of two land reference matters that came before, and decided by, High Court judge Aliza Sulaiman.
In the first land reference matter, the Applicant was the registered proprietor of land with an area of 152.448 square metres (sqm). The land is on a 99-year lease. With the lease expiring in 2078, the remaining tenure was 57 years.
The land use category was “Bangunan” while the express condition was “Rumah Kediaman”. A double-storey (formerly single storey) terrace house was situated on the land.
In the second matter, the Applicant was the registered owner of the land with an area of 152.541 sqm. The land is also on a 99-lease with the lease also expiring in 2078 and the remaining tenure of 57 years as well.
The land use category and express conditions were also “Bangunan” and “Rumah Kediaman” respectively. A 1½ storey terrace house was situated on the land.
The award of compensation for the Applicant in the first land reference matter was RM1,302,641.83. In the second, the award was RM1,023,000.00.
In both matters, Justice Aliza Sulaiman did not find valid reasons to disturb the awards and accordingly maintained the awards.
The awards were in seven figures. But it is not about the awards being in seven figures; it is about the awards adequately reflecting the market value of the land and building.
