SHAH ALAM, Oct 28 — Datuk Seri Mohd Shuhaily Mohd Zain’s position at the Malaysian Border Control and Protection Agency (AKPS) has been referred to the Attorney General's Chambers (AGC) for legal guidance before any recommendation to truncate or terminate his tenure is submitted to the Yang di-Pertuan Agong.
Inspector-General of Police Tan Sri Mohd Khalid Ismail said the matter has simultaneously been escalated to the Police Force Commission (SPP) for regulatory review, Berita Harian reported.
Mohd Khalid explained that legal consultation with the AGC is mandatory because Shuhaily's two-year posting to head the border agency was structured as a formal cadre secondment from the Royal Malaysia Police (PDRM) that received the constitutional assent of the King.
“We are referring this matter to the AGC because Datuk Seri Mohd Shuhaily’s assignment at AKPS is for a period of two years.
“It is like a contract, and this contract was granted the consent of the Yang di-Pertuan Agong.
“Therefore, should anything arise involving suspension from duty or similar matters, the action to be taken will depend on the AGC’s advice. In any case, any matter concerning termination of the contract and so forth must be submitted to the Yang di-Pertuan Agong for consent,” he said.
The IGP spoke to the press on the sidelines of the National Conference on Bureaucratic Red Tape Reform 2026, organised by the Malaysia Productivity Corporation (MPC), with Chief Secretary to the Government Tan Sri Shamsul Azri Abu Bakar in attendance.
Mohd Khalid said that legal counsel is vital to ensure that any disciplinary intervention strictly observes contractual stipulations without encroaching on royal prerogative.
Once the AGC concludes its review and the palace decides on his secondment status, Shuhaily will revert to the police force for internal administrative determination.
“Upon his return, I may provide a more detailed explanation of the matters that need to be addressed and the follow-up action to be taken, God willing,” he said.
Concurrently, Shamsul Azri clarified that federal administrative leadership has entrusted the management of the case entirely to the Home Ministry and the police high command.
“As far as the PDRM is concerned, let them handle it first,” he said, directing questions regarding procedural inquiries to senior police leadership.
