KUALA LUMPUR, Nov 29 — Residents of Taman Tun Dr Ismail (TTDI) today failed in their application to obtain a summary judgment in their suit against a project of Mass Rapid Transit Corporation Sdn Bhd (MRT Corp).
Judge Rosilah Yop dismissed their application with a cost of RM10,000.
The residents had applied to dispose for the court to dispose their suit without trial as provided under Order 14 of the Rules of Court 2012.
Ho Lee Yoke, 55, and 11 others filed the suit in February.
In their statement of claim, the residents, who own link houses along Jalan Pinggir Zaaba, said MRT Corp had a duty to ensure that the project was implemented legally and safely.
They are seeking, among others, a declaration that the project is illegal and unlawful and that they are entitled to compensation.
Alternatively, they are seeking general and equitable damages as well as RM22,000 in special damages. — Bernama
