GEORGE TOWN, July 19 — The High Court today acquitted and discharged two men charged with the murder of a man in 2011 without calling for their defence.

Justice Datuk Zamani Abdul Rahim freed Mohd Fazli Abdul Rahman, 33, and Muhamad Hafis Md Yusoff, 28, of the charge of having murdered Yuganthan Uthayakumar, 23, at about 1am on February 25, 2011, in Taman Lima Kongsi, Sungai Bakap.

Mohd Fazli and Muhammad Hafis, who had been in custody for a year, shed tears and rushed out of the court into the arms of family members.

“After hearing the testimony of 13 witnesses, the court has decided that the prosecution failed to make out a prima facie case against the accused. As such, the court orders their acquittal and discharge without calling for their defence,” Zamani said.

Mohd Fazli and Muhammad Hafis were represented by counsel R. Dev Chander and V. Parthipan who said their clients would be able to celebrate Aidilfitri with their families.
