SINGAPORE, Aug 1 — The High Court has convicted a Belgium national who pleaded guilty to a charge of culpable homicide not amounting to murder for the death of his five-year-old son.

The court heard today that Philippe Graffart, 42, caused the death of Graffart Keryan Gabriel on October 5 last year in their unit at D’Leedon Condominium at Leedon Heights.

The incident was said to have taken place on that night between 9pm and 10.17pm.

Philippe had used a cushion to press down on Keryan’s head, which prevented the child from breathing.

At the time of the incident, Philippe and his ex-wife were fighting over Keryan’s custody.

According to a psychiatric report, Philippe was suffering from major depressive disorder, which had "substantially impaired his thinking process and judgement” of his acts leading to the death of Keryan.

Philippe was charged with murder on October 7.

His charge was amended to culpable homicide in March.

In response to media queries on why the prosecution amended the charge at that time, the Attorney-General’s Chambers said: "Every case is assessed on its own merits.

"The Prosecution carefully considered the facts and circumstances of this case.

"The accused suffered from major depressive disorder which substantially impaired his mental state at the time of the offence.

"The charging and sentencing position will be made clear when the matter is heard in open court.”

Philippe is expected to be sentenced on August 22.

He could be jailed for up to 10 years, with a fine or caning, or any combination of such punishments. — TODAY
