LOS ANGELES, Oct 2 — French actor Olivier Martinez, known for films including Unfaithful and S.W.A.T., has been granted a temporary restraining order against Oscar-winning actress Halle Berry after accusing her of physically abusing their 12-year-old son.

A Los Angeles County judge granted Martinez’s request on October 1, temporarily restricting Berry’s visitation with their son Maceo ahead of a hearing on October 16, entertainment news outlet People reported today.

Martinez, 60, had sought sole custody of Maceo, alleging that Berry physically abused the boy during an incident on September 26.

Martinez alleged that Berry jumped on Maceo, put her hands around his neck and choked him, People reported, citing from court documents.

He also alleged that Maceo called him during the incident and asked him to come and get him.

Martinez further claimed there had been other instances of physical, verbal and emotional abuse, allegations that have not been established in court.

Berry’s lawyer Marina Beck described the filing as “entirely meritless and deliberately misleading”, while Martinez’s lawyer Patrick Baghdaserians said his client’s concern was the child’s “health, welfare and safety”.

The former couple finalised their divorce in 2023 after marrying in 2013 and separating in 2015, with their divorce agreement providing for joint legal custody of Maceo.

Berry reportedly agreed to pay Martinez US$8,000 (RM33,600) a month in child support, plus 4.3 per cent of any income she received above US$2 million (RM8.4 million).

The former couple also underwent court-ordered co-parenting therapy in 2024 amid disagreements over how to raise their son.

Martinez is a César Award-winning actor who rose to prominence in French cinema before moving into international productions.

He and Berry met while working on the 2012 film Dark Tide and married the following year.
