KUALA LUMPUR, Dec 20 ― The High Court here today discharged and acquitted G. Gunasekaran, the second accused in the murder trial of deputy public prosecutor Datuk Anthony Kevin Morais, of murder.
"The accused has pleaded guilty in the Sessions Court to causing disappearance of evidence, under Section 201 of the Penal Code.
"I pray that the charge against Gunasekaran under Section 302 of the Penal Code be withdrawn,” said DPP.
The Sessions Court sentenced Gunasekaran to two years in jail effective from the date of his arrest on September 15, 2015 after he pleaded guilty to concealing Kevin Morais' body and disposing of the plate number of the deceased's car, WA 6264Q.
Gunasekaran and five other men, R. Dinishwaran, 24, A.K. Thinesh Kumar, 26, M. Vishwanath, 26, S. Nimalan, 23, and S. Ravi Chandaran, 45, had earlier claimed trial to murdering Kevin along Jalan Dutamas Raya Sentul to No. 1 Jalan USJ1/6D, Subang Jaya, between 7am and 8pm on September 4, 2015.
Pathologist Col Dr K. Kunaseegaran, 53, claimed trial to abetting the six men in killing Kevin, 55, at the same place, date and time.
Dr Kunaseegaran is charged under Section 109 of the Penal Code read with Section 302 of the same Code while Gunasekaran was charged with the five men, under Section 302, which carries the mandatory death sentence on conviction.
The DPP also told the court that Gunasekaran, 48, would be a witness for the prosecution and testify in the trial tomorrow.
Meanwhile, Gunasekaran will serve his sentence in Kajang Prison. ― Bernama
