KUALA LUMPUR, Nov 7 — The government does not plan to amend the way the Attorney-General, Bank Negara Malaysia governor and Inspector-General of Police are currently appointed, said Datuk Seri Azalina Othman Said.
The minister in the Prime Minister’s Department said the appointments were being done in accordance to the law and there was consequently no reason to amend the Federal Constitution to alter these.
"The appointment of the AG is based on Clause (1) Article 145, the BNM governor follows the Subsection 15 (1) BNM Act 2009 while the IGP is in accordance with Clause (4) Article 140 of the Federal Constitution,” she said in a written parliamentary reply to Bukit Gelugor MP Ramkarpal Singh.
Ramkarpal on November 1 had asked the prime minister if amendments will be made to the Federal Constitution to reduce the powers of the PM in the appointments of these top officers.
Former Attorney-General Tan Sri Gani Patail, who was removed last year, previously said that the position of the AG did not come with a secure tenure such as enjoyed by the judges of the superior courts.
He conceded, however, that this meant the prime minister was empowered to replace the officeholder as the latter "deems fit”.
