CCM raids NOW's office without written notice, demands financial records

KUALA LUMPUR, Oct 14 ― The Companies Commission of Malaysia (CCM) raided the National Oversight and Whistleblower (NOW) centre's office this morning and had demanded access to the PKR-linked group's financial records despite not having any formal written notice to do so,  Rafizi Ramli said today.

Rafizi, who is Pandan MP and NOW chief claimed that the 11am raid by CCM failed to comply with the standards procedures and powers legally accorded to the commission.

"I was informed by NOW executive director Akmal Nasir who is at the office, that the CCM officers did not give any written notice to check NOW's financial records.

"This goes against the law as the CCM does not have the power to come without any written notice and check any documents belonging to a company or association,” he said in a statement.

Rafizi added that the CCM officers had said that their morning inspection was to ensure that NOW fully complied with Section 167 of the Companies Act 1967 which requires officials and directors to keep complete financial records for up to seven years.

After referring the matter to his lawyers, Rafizi said he instructed NOW's staff to not release or give any information to the CCM officers until and unless a written notice was provided.

"As the founder of NOW who has met with numerous scare attempts, I have nothing to hide,” he said.

He added that NOW will only cooperate once CCM can provide a written notice that is in accordance with the law.

If the notice does not meet the requirements stipulated under the said Act, Rafizi said he will discuss with his lawyers on how to challenge the notice.
