Police probe deadly go-kart accident for negligence

KUALA LUMPUR, Sept 26 — Police are currently looking for any signs of negligence in yesterday’s go-kart race in Kuantan, Pahang, that left two spectators dead and a few injured.

Pahang deputy police chief Datuk Azri Ahmad said the incident is being investigated under Section 304A of the Penal Code that deals with deaths caused by any rash or negligent act not amounting to culpable homicide.

"The investigation is focused more on negligence than criminal,” Azri told Malay Mail Online.

"The probe is ongoing and, as of now, we have not found any criminal element that could have caused the accident,” he added.

Section 304A carries a maximum prison term of two years, or a fine, or both.

Izwan Isa, 39, and his four-year-old daughter Nur Zulaikha were killed when a go-kart careened off the road and into the crowd at the Educational Innovation of Motorsports and Automotive (EIMARace) 2016 go-kart race at Indera Mahkota organised by Universiti Teknologi Malaysia.

A video of the incident appeared to show that spectators were only separated from the track and racing go-karts by plastic dividers that flew away the instant these were hit by the go-kart.

Organisers had also asserted that the spectators were in a "prohibited” area.

National newswire Bernama reported Higher Education Ministry secretary-general Tan Sri Dr Noorul Ainur Mohd Nur as saying that the ministry has set up a special committee to investigate the accident.
