KUALA LUMPUR, May 5 ― The High Court here expunged today parts of Tony Pua's affidavit in Prime Minister Datuk Seri Najib Razak’s defamation suit against the DAP lawmaker as they were considered hearsay.

Justice Datuk Roslan Abu Bakar said that two paragraphs of Pua's affidavit ― related to a Companies Commission of Malaysia (CCM) search on state investment firm 1Malaysia Development Berhad (1MDB) and also several articles sourced online regarding the company ― did not reveal the proper source of information.

“There is also no explanation on why the defendant relied upon (the information),” Roslan said.

An application by Najib's lawyers to strike out parts of an affidavit by the second defendant, Mediarakyat.net owner Chan Chee Kong, had failed.

“I find the contents to be a fair comment and not defamatory,” Roslan said.

Pua's lawyer Gobind Singh Deo said that he will study the grounds of the judgement before a decision is made on whether Pua will appeal the matter. Najib was represented by Datuk Hafarizam Harun. Najib filed the suit against Pua and Chan on March 5 last year over comments made by Pua during a DAP fund raising dinner, which was then uploaded on Mediarakyat.
