KUALA LUMPUR, April 13 — A lawyer acting for the prime minister questioned today if foreign prosecutors scrutinising 1Malaysia Development Berhad (1MDB) are in full possession of the complete set of documents and facts surrounding the sovereign investment firm, including the Public Accounts Committee’s (PAC) report on 1MDB.
Lawyer Datuk Mohd Hafarizam Harun also questioned the extent of the powers of investigating authorities abroad against non-citizens.
“They may have just got one part of the documents. Have they got the PAC report, have they seen the report by the Attorney-General exonerating the prime minister on the RM2.6 billion, have they looked at the MACC report or statement in August last year, were all these taken into account?
“What I’m worried is that the prosecutors of other jurisdictions are only confined to documents that have been given by one side of the parties. Did they use the mutual legal assistance and get all the documents including the recent PAC report? I don’t think so,” he told reporters when met at the court complex here.
Mohd Hafarizam also said he does not think that foreign prosecutors abroad would be able to act against a non-citizen.
“So these actions by foreign prosecutors, the first issue that I think you need to look at is whether they have jurisdiction to take action against the prime minister of Malaysia, who is a Malaysian citizen and not the citizen of Switzerland or Germany or even US?
“So can you extend your extra-territorial jurisdiction outside your country and bind a non-citizen?” he asked.
1MDB is currently under probe by the authorities in several countries, with Luxembourg the latest to investigate the state investment firm for alleged money laundering.
