KUALA LUMPUR, Feb 18 — The High Court today turned down the application of Raja Datuk Seri Izzuddin Iskandar Shah ibni Almarhum Sultan Idris A’fifullah Shah for a judicial review concerning the stripping of his title as the Raja Kechil Besar of Perak.
Judge Datuk Hanipah Farikullah Shamsul also ordered Raja Izzudin to pay cost of RM3,000 to the Government of Malaysia.
The judge made the decision in chambers in the presence of senior federal counsel Shamsul Bolhassan and Raja Izzuddin’s counsel Mohamad Sofee Razak.
Speaking to reporters, Shamsul said the court rejected Raja Izzuddin’s application after allowing the preliminary objection by the Attorney-General as the respondent.
He said the court was satisfied and accepted their submissions in the preliminary objection that the Sultan of Perak did not act on his personal capacity in relation to the stripping of the title, but was only exercising the royal prerogative power as stipulated under Article 37 of the Perak Constitution.
In this matter, the royal prerogative power of the Sultan of Perak can neither be reviewed nor challenged, Shamsul said.
On Oct 9 last year, Raja Izzuddin, 63, filed the application for a judicial review of the decision prohibiting him from initiating an appeal at the Special Court to annul the stripping of his title.
In his application, Raja Izzuddin is seeking an order to cancel and set aside the Attorney-General’s decision in rejecting his application to initiate an appeal at the Special Court on the Restoration of Rights and Seniority Status of Raja-Raja Bergelar Negeri Perak (Perak Titled Rajas) against the Sultan of Perak Sultan Nazrin Shah in accordance with Article 182 and 183 of the Federal Constitution.
He also claimed that he was still a valid heir to the throne of Perak as stated in Clause VII (1) of the Perak State Constitution. — Bernama
