Woman who intended to marry IS jihadist sees jail term upheld

PUTRAJAYA, Jan 20 ― A former female assistant credit officer will be released from prison in two weeks time after she completes her two-year-jail sentence for attempting to give support to the Daesh militant group by marrying one of its members.

The prosecution's appeal, in an attempt to have Ummi Kalsom Bahak's jail sentence enhanced to seven years, was unanimously dismissed by a five-man bench of the Federal Court chaired by Court of Appeal president Tan Sri Md Raus Sharif.

Justice Raus held that the facts of the case did not show that Ummi Kalsom was directly involved with the militant group.

He said her intention was to marry the man she was in love with, thus there was no reason for the court to interfere with the High Court order which was also affirmed by the Court of Appeal.

Ummi Kalsom, 26, was sentenced to two years jail by the High Court last year after she pleaded guilty to attempting to give support to Daesh by trying to enter Syria by boarding an AirAsia flight to Brunei and onwards to Istanbul, Turkey to marry Daesh member Aqif Huessin Rahizat, 25.

She committed the offence at the Immigration counter of the International Departure Hall, at the KL International Airport (klia2), at 5.20am on Oct 5, 2014.

Ummi Kalsom was ordered by the High Court to serve her jail term from the date of her arrest on Oct 5, 2014. She is currently being detained at the Kajang Prison.

The prosecution appealed to the Federal Court after it lost its appeal at the Court of Appeal on July 30 last year for heavier sentence against Ummi Kalsom.

In today's proceeding, Deputy Public Prosecutor Awang Amardajaya Awang Mahmud asked the court to enhance Ummi Kalsom's jail sentence to seven years and also for her to be given rehabilitative counselling.

He said a two-year-jail term was insufficient for her to undergo counseling to help her turn a new leaf.

Her counsel Datuk Hanif Hassan, however, said the High Court had rightly imposed a two-year-jail sentence on his client.

He said Ummi Kalsom is scheduled to be released from prison on Feb 5, this year and she is ready to return to society as a new person.

Hanif said in prison she was exposed to the study of the Al-Quran and Hadith.

"When she is released from prison, she intends to assist the authorities to enlighten the public about the dangers of violent movements by giving motivational talks," he said.

Ummi Kalsom is the first woman to be affiliated to a member of the group and her case is also the first case involving a woman facing a charge of supporting the militant group to reach the Federal Court. ― Bernama
