IPOH, Sept 25 — A convict who is still serving a jail sentence, was today sentenced to 45 years jail and 16 strokes of the Rotan by the High Court here, for rape and robbery, four years ago.
Judicial Commissioner Noorin Badaruddin made the decision against Mohamad Khairi Bahauddin, 32, after allowing an appeal by the prosecution for the sentences on five charges to be carried out separately.
Prior to this, on March 26, the Sessions Court had decided that the sentences on Mohamad Khairi for all charges be carried out simultaneously.
However, the High Court today ordered the accused to be jailed for 45 years and caned 16 times after completing his eight-year jail and five strokes of the Rotan in 2016.
Mohamad Khairi is currently serving the sentence at the Tapah Jail for raping an 18-year-old girl in a women’s public toilet at Glutton Square near Teluk Intan here, on April 19, 2010.
In his judgement, Noorin said, after scrutinising his crime record and modus operandi, the defendant did not get the sympathy of the court because his offences were heavy and repeated.
“The court accepts the appeal of the prosecution for the sentence to be served separately. The respondent must be isolated from society as he could pose a threat and a large portion of his life be spent in jail, as it will be beneficial to him,” he said.
On August 7, 2010, the accused had raped two girls and robbed them of a hard disc player, a Sony Ericsson cell phone and RM500 cash.
Furthermore, the accused also robbed Chong Hooi Ling, 17, of an Ericsson W995 handphone and RM40 in cash.
The accused committed the offences between 6.40am and 7.15am at No 30, Lebuh Perajurit 3 at Taman Ipoh Timor here.
The prosecution was led by deputy public prosecutor How May Ling and Muhammad Fauzi Md Yusof while the accused was represented by Mohamad Hafiz Jalaludin. — Bernama
