June 30 hearing for Iranian with alleged links to Bangkok bombers

PUTRAJAYA, March 31 — The Federal Court here will hear on June 30 the appeal brought by an Iranian, who is wanted by the Thai government over the 2012 alleged bomb blast in Bangkok, on his bid to secure his release.

A five-member panel chaired by Court of Appeal President Tan Sri Md Raus adjourned the matter to that date to enable Sedaghatzadeh Masoud’s counsel, Tan Sri Muhammad Shafee Abdullah, to obtain a Sessions Court’s grounds of judgment on an extradition order for Masoud.

The Sessions Court in Kuala Lumpur, had on June 25, 2012, issued an order for Masoud, 33, to be extradited to Thailand.

He subsequently filed a writ of habeas corpus seeking to secure his release, but the application was dismissed by the Kuala Lumpur High Court on September 5, 2012.

Masoud, currently detained at the Sungai Buloh prison, is appealing to the Federal Court against that High Court’s dismissal of his writ of habeas corpus.

In his writ of habeas corpus, Masoud named then Home Minister Datuk Seri Hishammuddin Hussein, the Sungai Buloh prison director and the public prosecutor as respondents.

In today’s proceedings, Muhammad Shafee applied for the Federal Court to issue a directive to the then Sessions Court judge S.M. Komathy Suppiah (now judicial Commissioner) to provide her written grounds of judgment.

However, Justice Raus said the court was not going to make any order concerning the request for the grounds of judgment, saying that the matter should be dealt with administratively through the court’s registrar.

 Masoud was detained under the Immigration Act on February 15, 2012 at the Low-Cost Carrier Terminal (LCCT) in Sepang upon arrival from Bangkok while on transit to Iran.

He was detained on a request from Bangkok after the Thai authorities suspected that he had links with two Iranians who were nabbed following an explosion at a house in the Thai capital on February 14, 2012.

The basis for the extradition request was that Masoud was a fugitive criminal and he was wanted to stand trial in a Thai court as stated in the warrant of arrest issued by the South Bangkok Criminal Court on February 15, 2012.

Deputy Public Prosecutors Kamal Baharin Omar and Abazafree Abas appeared for the respondents. — Bernama
