SHAH ALAM, Feb 26 ― The High Court here today sentenced two siblings to death after they were found guilty of murdering a 75-year-old senior citizen during an armed robbery four years ago.    

Judge Ghazali Cha sentenced Mohd Shamsul Abdul Aziz @ Abdul Azis, 46, and his sister Tuti Adayu, 34, after the victim Nenn Ariffin's wife Siti Aminah Lateh, 73, made her victim impact statement, saying, “I've lost the one person whom I depended upon.”

Ghazali also sentenced the brother and sister to eight years in prison effective from the date of their arrest on March 2 2010, with three strokes of the cane to Mohd Shamsul for robbing Siti Aminah of two gold chains and two bangles, armed with a knife.   

He held that they had failed to raise a reasonable doubt on the prosecution's case and their defence was a mere fabrication and after thought. 

Mobile phone shop worker Mohd Shamsul, and mother of three Tuti Adayu, were charged with killing Nenn about 8.15pm on February 27 2010 at No: 35, Jalan Kembojasari 12, Bandar Sungai Buaya, Bukit Sentosa, Hulu Selangor, under Section 302 of the Penal Code which carries the mandatory death sentence upon conviction. 

They were also charged with gang robbery under Section 395 of the Penal Code

which is punishable by a maximum of 20 years in prison and caning, if convicted.

“I'm satisfied with the prosecution's proof of the duo's intention to commit the crime. It was further corroborated by the testimony of Siti Aminah. I hereby find them guilty as charged and sentence them to death,” he said.    

The prosecution was conducted by deputy public prosecutor Rosidah Abu Bakar, who called on 34 witnesses throughout the trial.
