KUALA LUMPUR, Dec 13 — The High Court here today rejected the prosecution’s appeal against the Sessions Court’ ruling to discharge and acquit former Jeli MP Mohd Apandi Mohamad of 13 counts of falsifying documents.
Justice Kamardin Hashim in upholding the lower court’s decision, said the prosecution’s appeal did not have merit.
“The decision made by the Sessions Court was apt and correct,” he held.
On February 11, 2011, Judge Nasir Nordin acquitted Mohd Apandi without calling for his defence.
Mohd Apandi, 53, who was at the time Jeli PAS representative, was accused of submitting a false claim to the finance branch at the Parliament office in Jalan Parlimen here between February 11, 2002 and July 23, 2003, for hotel charges at Hotel Perdana Resort, Pantai Cahaya Bulan in Kota Baru totalling RM31,050.
He was represented by counsel Datuk Sukri Mohamed while the prosecution, by deputy public prosecutor Abdul Ghafar Ab Latif. — Bernama
