Couple in assault caught on viral video decide against trial

IPOH, Dec 5 — The case of a businessman featured in a CCTV recording allegedly abusing his wife was finally put to rest after the couple agreed to a mutual settlement yesterday.

Both parties, together with their counsel, agreed that the matter be sorted out amicably without the need for a trial.

Calven Chik, charged under Section 323 of the Penal Code with intent to cause hurt to his wife, Amanda Fong, on Aug 23 last year, made a verbal apology to her in open court room before magistrate Nor Suhaima Mohd Nor.

Fong, represented by counsel Tan Sri Darshan Singh Gill, was told to step forward when Chik made his apology.

“I know what I did was wrong. I am sorry for my actions. You know clearly what happened and why it happened. I’m sorry again,” Chik said.

Chik’s counsel, Dexter Mah, said  that besides the apology, the couple agreed to file a mutual divorce petition without any party making any claims, and Fong’s name to be removed from any joint businesses they owned.

“Chik will also make an ex-gratia payment of RM2,500 to Fong,” he said.

Nor Suhaima accepted the terms of the settlement and deemed the case closed as permitted under Section 260 of the Criminal Procedure Code.

Darshan said Fong had agreed to the compromise so the couple could move on with their lives.

“It’s been more than one-and-a-half years and this is the best solution for both of them,” he said outside the courtroom.

“Too many dirty linens have been exposed in public. It’s best the matter is resolved between themselves.”

Fong had uploaded a CCTV recording of the alleged abuse on Facebook in August last year before it went viral.

The couple lodged separate police reports on Sept 3, following which the state Welfare Department obtained an interim restraining order by the Ipoh High Court against her husband.

Fong later revealed the bruises and bite marks on her body at a press conference and claimed  the abuse was sparked by a quarrel over business matters.

Chik also made public an additional hour-long footage of the incident to clear his name. He  claimed he was trying to calm Fong down and had persuaded her to go to the hospital.
