KUALA LUMPUR, Sept 20 — Luxury hotel stays, prostitutes and Lady Gaga concert tickets ... these were among the bribes allegedly offered by a Malaysian businessman to gain favours from a naval commander and a Naval Criminal Investigative Service (NCIS) special agent.
Leonard Glenn Francis, 58, who is CEO of Singapore-based Glenn Defence Marine Asia Ltd, was charged in San Diego on Tuesday with bribing the two officers.
Francis, who was arrested in San Diego on Monday, was charged with bribing the duo with prostitutes and luxury travel in exchange for confidential information on multimillion-dollar work contracts.
Francis had allegedly bribed US Navy Commander Mike Misiewicz, 46, to redirect US Navy vessels to ports operated by Glenn Defence Marine Asia.
These contracts, which include providing tugboats, security, fuel, waste removal and other services, were said to be worth hundreds of millions of dollars.
According to foreign newspaper reports, Francis returned the “favours” by giving Misiewicz gifts, including hotel stays, prostitutes and five tickets to a Lady Gaga concert in Thailand in May 2012.
Misiewicz, who is assigned to the Peterson Air Force Base in Colorado Springs, was arrested in Colorado on Monday, and NCIS Special Agent John Beliveau, 44, was arrested in Virginia.
Misiewicz was commander of USS Mustin from June 2010 to January 2011, when he was transferred to serve on USS Blue Ridge as deputy operations officer, where he had influence over operations for ships in the Seventh Fleet or any ship travelling through its operations area.
Reports alleged Misiewicz diverted US Navy ships to ports in Malaysia, Thailand and Indonesia instead of docking in Singapore and the Philippines, which would make less money for Francis and his company.
According to a report by NBC 7 in San Diego, Francis is also accused of providing gifts to Beliveau, 44, in exchange for documents from 2011 to 2013, regarding a fraud investigation into Glenn Defense Marine Asia.
One of the trips allegedly included a three-week tour through five Asian countries in December 2012.
The complaint alleged that in return, Beliveau helped Francis craft a response to an NCIS inquiry and even searched an internal database several times for details.
Documents show that once he was transferred to Quantico, Beliveau emailed Francis: “I will always be your friend but you will get nothing else until I get what you promised.”
The complaint shows Beliveau went on to write: “I can be your best friend or your worst enemy … I am not an amateur.”
All three men are charged with conspiracy to commit bribery, which carries a five-year federal prison term.
The Glenn Marine Group was established in Malaysia in 1946 and is primarily engaged in marine-related industries.
The group now has presence in over 45 countries worldwide and owns one of the largest private marine fleets in Asia with over 100 vessels and barges
In June 2010, the group acquired Port Klang Cruise Centre in Pulau Indah.
The acquisition marked its venture into the cruise tourism industry and transition from a pure marine logistics services provider to a full-fledged player on the maritime stage.
The Glenn Marine Group had also submitted a proposal to the government last year to develop a container port with a 1.5km wharf at Port Klang Cruise Centre (PKCC) in Pulau Indah with an estimated cost of RM1.5 million. However, the project never got off the ground.
A source at Wisma Putra said they “had knowledge” of what was going on but were not interfering as the alleged offence concerned the laws and jurisdiction of another country.
