PUTRAJAYA, Feb 21 — The Federal Court’s decision on Monday on the redelineation of electoral boundaries is proof that the exercise had fulfilled all the principles and requirements as contained in the Federal Constitution, says Election Commission (EC) chairman Tan Sri Mohd Hashim Abdullah.
“The decision is a judicial recognition of the division of powers between the executive, legislative and judiciary in line with the doctrine of separation of powers which is the practice in this country,” he said in a statement here today.
Therefore, the EC hoped all parties would accept and respect the decision, he added.
On Monday, the Federal Court dismissed the application of several parties to initiate the judicial review to challenge the delineation exercise carried out by the EC in Perak and Melaka.
In a related matter, Mohd Hashim said the EC also took note of the decision of the Court of Appeal today, which dismissed the Penang Government’s appeal on the delineation exercise in the state.
In line with the responsibilities entrusted, he said the EC would continue with the redelineation exercise until the final report was submitted to Prime Minister Datuk Seri Najib Razak, as contained in the Federal Constitution.
“The EC’s responsibility in the matter will be completed after the final report is submitted to the prime minister,” he added.
According to Mohd Hashim, the presentation of the report at the Dewan Rakyat was up to the prime minister as it would no longer come under the purview of the EC. — Bernama
