PETALING JAYA, Oct 28 — Four men were sentenced to a day’s jail each and fined RM900, in default 20 days jail by the Magistrate’s Court here today over a fracas involving custody of a seven-year-old girl, last month.

Datuk Khairil Muzamil Abdul Rahman, 32, a businessman, Mohd Akmar Ashraf Ishak, 32, Muhammad Afiq Md Nor, 29, and Mohamad Nazurin Mohd Zaini, 25, all pleaded guilty before Magistrate Salaimah Salleh for fighting in public on Sept 23.

The offence was committed at Sekolah Kebangsaan Bandar Utama 4, Jalan BU 4/6 Damansara Utama, Petaling Jaya, here at around 3.30pm, under Section 160 of the Penal Code.

They were liable to be jailed up to six months or fined up to RM1,000, or both.

A video clip of the incident, which went viral among netizens, showed Mohd Adli Effendy Mohd Zaki, 35, the father of the girl, tussling with the four men and his ex-wife.

The commotion was ignited over the custody of thei girl, which the mother had won at the Syariah Court, earlier this year.

During mitigation, all four, who were unrepresented, appealed to the court to give a light sentence saying they were only showing their support to their cousin (the ex-wife) and furthermore, Khairil Muzamil, Mohd Akmar, and Muhammad Afiq had parents to look after while Mohamad Nazurin had a brother studying in University.

Deputy public prosecutor Nur Aishah Ahmad Zakiuddin urged the court to give a deterrent sentence as the seriousness of the fight caused injuries to the wife, as well as to take into consideration the emotional scar that has been left on the daughter.

Mohd Adli, a former reporter, who was represented by lawyer Muhammad Hafiz Hood, however, claimed trial to the same charge.

The court set bail at RM1,000 with one surety and fixed Nov 28 for mention.

Salaimah before handing down the punishments admonished the four saying that they should be ashamed of themselves over the conduct they showed regarding the matter.

“Just because of your disputes, the child has been subjected to emotional harm. This is not the way to show love for children, there are many other ways.

I hope this serves as a lesson,” she said. — Bernama
