KUALA LUMPUR, March 3 — The Ulu Kelang Recreation Club (UKRC) today lost its claim over a field in Kuala Ampang, Hulu Kelang to the Ampang Jaya Municipal Council (MPAJ). 

Judicial Commissioner Vazeer Alam Mydin Meera held that the field was owned by the state government of Selangor.  

He said the plaintiff, UKRC, had no right to make a claim on the land and furthermore Section 8(1) of the Specific Relief Act 1950 quoted by the plaintiff was obsolete.

“Moreover, when the Kuala Ampang MPAJ field was gazetted as an open space in 2004, UKRC did not make any claim on it in court,” he said.

In 2003, a state government meeting had also gazetted the field for public use, he added.

The court UKRC to pay RM20,000 in cost to MPAJ. 

UKRC filed the originating summons on Oct 21 last year naming MPAJ as the defendant.

In its statement of claim, UKRC sought a declaration that MPAJ’s action of reclaiming the field on Lot 3026 in Kampung Kuala Ampang, Hulu Kelang, Selangor on October 1 2013 was without the consent of the club and unlawful.

The club also claimed that MPAJ’s action was in conflict with Section 8(1) of the Specific Relief Act 1950. — Bernama
